1. INFORMATION CARDWAYS COLLECTS FROM YOU.

Active Information Collection
Like many other web sites, we actively collect information from our visitors both by asking specific questions on this Web Site and by permitting you to communicate directly with us via e mail.  Some of the information that you submit may be personally identifiable (that is, information that can be uniquely identified with you, such as your name, address, e-mail address, phone number, etc.).

On the Web Site, during the registration process we specifically ask users for *Email (user id), *password, return address, billing information, *name, *address, *telephone, decade of birth, gender, information on how you heard about us, whether you would like us to donate part of the proceeds from your card orders to charity, your company code, and whether you would like to receive offers about new services and special offers.  Information preceded by an asterisk is required; all other information requested during the registration process is optional.  Registered users who provide this information can benefit from several features, including storing your account information, images and favorites, an address book, and reminder services.  Remember, if you send us an e-mail message, you provide us with your e-mail address.  If you make a purchase from the Web Site, we will collect your credit card number and the other information necessary to fill your order.  We may also collect information submitted by you on the name and date of events specific to a particular customer and recipient, your address book and address lists, your greeting card data and customization data, and your list of favorite greeting cards.

Passive Information Collection
As you navigate through a web site, certain information can be passively collected (that is, gathered without you actively providing the information) using various technologies and means, such as navigational data collection.  Like most web site operators, we track IP addresses, use both session and persistent cookies, and assign Internet tags.  Our system also automatically gathers information about the areas you visit on this Web Site and collects operational information about the technology you use, such as your browser, type of computer, operating system, and Internet service provider.  We also passively collect information that tracks usage and shopping basket information.

We passively collect information to understand what areas of this Web Site are most popular, which areas may require improvement, and what technologies are being used by our visitors.  This information helps us to update and improve this Web Site and its design.  We also use this information for security purposes, to detect and to block security breaches and to provide you with a safe online environment.

Cardways does not have control over the privacy policies applied by any other party to whom you may disclose information, including web sites operated by third parties that may be linked to this Web Site.  If you would like information on any other party's privacy policy, you should contact that party directly, and we encourage you to do so.

2. HOW CARDWAYS USES YOUR INFORMATION

Once you have customized a greeting card and/or gift card, Cardways does not generally edit, read, or check your customized text or uploaded images.  In light of this, all users are required to read the terms and conditions as to the restrictions and liability of all customization created by the user.  However, while we have no obligation to monitor any data you transmit to the Web Site (“Scanned Data”), Cardways and merchants offering products through the Web Site (“Merchants”), and third party service providers to Cardways or Merchants, reserve the right at all times to review the Scanned Data, to disclose the Scanned Data consistent with all laws, regulations or government requests and to report any potential violations of law to law enforcement authorities, to refuse to post or transmit the Scanned Data, to remove the Scanned Data, and to refuse to perform any orders for processing or fulfillment for Scanned Data, that are, in our sole judgment and discretion, (or in the sole judgment and discretion of our licensees, suppliers, fulfillers, or Merchants), Inappropriate Content, as defined in the Terms and Conditions, or otherwise in violation of the Terms and Conditions.

Cardways uses your personal information to enhance the operation of this Web Site and allow you to use all of its features.  Cardways will disclose your personal information to Merchants from whom you order gift cards through the Web Site and they may contact you about new features or products in which they believe you may be interested.  Cardways may disclose your personal information to service providers that assist us in processing information or delivering the items that our customers order.  These service providers are restricted by their agreement with Cardways or with the Merchant from using the information for any purpose other than helping to provide products and services.  Cardways may use information it collects for such purposes as responding to your requests, customizing future shopping for you, improving our site, and communicating with you.

Cardways may provide aggregate statistics about our customers, sales, online traffic patterns and related information to reputable third parties, but these statistics will not include any personally identifying information.  Cardways also will disclose any information when required by any local, state, or federal legal authority; when required to legally protect and defend the rights or property of Cardways; when Cardways believes it appropriate to protect its members, users, employees or the public; and when required to enforce or defend the conditions of Cardways’ Terms of Use.  In the event that Cardways or its business assets are bought, sold or otherwise transferred, the transferred business assets will likely include the information that Cardways has collected.

3. CHOICES YOU HAVE ABOUT HOW CARDWAYS USES YOUR INFORMATION

4. HOW CARDWAYS PROTECTS YOUR INFORMATION

We work hard to protect your personal information.  We use both technical and procedural methods to maintain the integrity and security of our databases, including online encryption (SSL), locating all servers, including the web servers, behind firewalls, and not storing customer data on any server with direct access to the internet.  All customer information and associated data is stored on physically secured servers.

Address and recipient lists, as well as reminder lists, are not accessed by Cardways except as requested by the customer.  They are maintained, along with credit card data and personal profile information, as a convenience to customer.
Except as otherwise set forth in this Privacy Policy, access to customers’ data is restricted to a select few employees of Cardways who have a specific requirement to access key information such as credit card information and shipping details.

Access to the individual customer’s data is available only to that customer by means of logging in and providing a username and password.  It is up to you as a customer to provide a secure password.  To help facilitate this, Cardways requires that all passwords be at least 6 characters in length.

The safety and security of your information also depends on you.  Never share your password with anyone else, notify us promptly if you believe your password security has been breached, and remember to log off of this Web Site before you leave your computer.

This Web Site contains links to other web sites operated by third parties that may be of interest to you.  We cannot control these third party sites, which may collect personal information from you.  When you follow a link and leave this Web Site, you do so at your own risk.
